1. The promoter is: Gagosian Gallery of London, a UK establishment of Gagosian Gallery International LLC, with UK establishment number BR006412 and whose registered address is located at 6–24 Britannia Street, London, WC1X 9JD (“Gagosian”).
2. The competition
2.1 The title of the competition is La Ribaute Private Tour and Lunch Giveaway.
2.2 By entering, you receive a chance to join an exclusive tour of the La Ribaute and private lunch, for you and a guest.
3. How to enter
3.1 The competition will run from 6am EDT on June 22, 2022 (the “Opening Date”) until 6am EDT on June 29, 2022 (the “Closing Date”).
3.2 All competition entries must be received by Gagosian by no later than 6am EDT on the Closing Date. Any entries received afterwards shall be automatically disqualified.
3.3 To enter the competition, simply complete and submit the online entry form at https://gagosian.com/features/anselm-kiefer-la-ribaute-private-tour-giveaway/.
3.4 No purchase from the website is necessary to enter the competition and there is no charge to register to use the website.
3.5 Gagosian will not accept:
(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of transmission as proof of receipt of entry to the competition.
3.6 By submitting an entry, you are agreeing to be bound by these terms and conditions.

4. Eligibility
4.1 The competition is only open to anyone aged 18 or over and any guest must be six years or over, except employees of Gagosian or its holding or subsidiary companies.
4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. Gagosian may require you to provide proof that you are eligible to enter the competition.
4.3 Gagosian will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk; or
(b) incomplete.
4.4 There is a limit of one entry per person.
4.5 Gagosian reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.
5. The prize
5.1 The prize is an exclusive tour of La Ribaute—a 40-hectare site located in the south of France near Barjac, north of Nîmes—led by Gagosian director Georges Armaos and private lunch amid the monumental installations of Anselm Kiefer, for you and a single guest.
5.2 There are 9 spaces available to be won, each with permission to bring a single guest. The 9 winners will be selected by random draw performed by a compute process from eligible entrants who have entered the competition in line with these terms and conditions.
5.3 The prize does not include travel insurance, the cost of transportation to and from La Ribaute, food and drink (outside of the private lunch), spending money, tax or personal expenses. Any costs that are incidental to the fulfilment of the prize are solely the responsibility of the winner(s).
5.4 You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary COVID-19 testing and vaccination requirements, visas and travel documents to attend the prize tour and lunch on the travel dates specified.
5.5 Gagosian reserves the right to substitute the prize with a prize of equal or greater value (as valued by Gagosian), including when circumstances beyond Gagosian’s control make it necessary to do so.
5.6 The prize is supplied by the Eschaton-Anselm Kiefer Foundation.
5.7 The prize is not negotiable or transferable.
5.8 In order to claim the prize you must confirm your acceptance via email:
(a) including any accessibility, allergy and/or dietary restrictions / requirements you or your guest may have; and
(b) in accordance with any further instructions provided by Gagosian on how to accept your prize.
5.9 By claiming the prize, you acknowledge and accept, and shall procure and be responsible for the acknowledgement and acceptance by your guest, of any additional terms related to your attendance to La Ribaute notified by Eschaton-Anselm Kiefer Foundation from time to time, including the terms set out at the “Important Practical Information’ and ‘Accessibility’ sections at https://eschaton-foundation.com/visit-la-ribaute/.
5.10 You agree (and shall procure that your guest agrees) that Gagosian may photograph and/or film and/or record you and your guest during your attendance at and/or participation in the prize and related activities (“Recording”) and may use both of your images, including for promotional, commercial, and internal Gagosian purposes. You grant (and shall procure that your guest shall grant) Gagosian the right to use for the maximum time allowed by applicable law, throughout the world and without any compensation, any Recording of you and your guest in any media, for the purpose of advertising, promotion, or any other commercial purpose in connection with the promotion of the competition, prize or future events, in Gagosian campaigns and/or for other Gagosian promotional activities.
5.11 You hereby assign (and shall procure that your guest assigns) all your right, title and interest relating to your entry to the competition, including all associated intellectual property rights and exploitation rights in any media for the purposes of performing the competition and any related activities (including, without limitation, promoting, advertising and marketing the competition), to Gagosian. If for any reason, an assignment is not possible, at Gagosian’s sole option: (i) you and your guest will hold the rights exclusively on trust for Gagosian and will enter into any documents Gagosian requests to effect the transfer; or (ii) you and your guest grant Gagosian an unconditional, exclusive, perpetual and worldwide license to do acts that would otherwise infringe the rights.
5.12 You agree (and shall procure that your guest agrees) that Gagosian may use your entry to the competition with or without using you and/or your guest’s name, in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party. By taking part in the competition, you agree not to instigate, support, maintain, or authorise any action, claim, or lawsuit against Gagosian, or any other person, on the grounds that any use of your entry to the competition, including all associated activities or any derivative works, infringe any of your rights, including, without limitation, copyrights and moral rights.
6. Winners
6.1 The decision of Gagosian is final and no correspondence or discussion will be entered into in relation to the selection of the prize winners.
6.2 Gagosian will contact the winner as soon as practicable after the Announcement Date (see below), using the telephone number or email address provided with the competition entry. Gagosian will not amend any contact information once the competition entry form has been submitted.
6.3 Gagosian shall announce the prize winners on July 15, 2022 (the “Announcement Date”).
6.4 If you object to any of the details set out at condition 6.3 (above) being published, please contact Gagosian at laribaute@gagosian.com. In such circumstances, you acknowledge that Gagosian may still provide the information and winning entry to any relevant advertising or competition authority on request.
7. Claiming the prize
7.1 If you are the winner of the prize, you will have 72 hours from being contacted by Gagosian to claim the prize, subject to condition 5.8. If you do not claim the prize by this date, your claim will become invalid.
7.2 The prize may not be claimed by a third party on your behalf.
7.3 Gagosian will make all reasonable efforts to contact you if you are a winner. If you cannot be contacted or are not available, or have not claimed your prize in accordance with these terms and conditions, Gagosian reserves the right to offer the prize to the next eligible entrant selected from the valid entries that were received before the Closing Date.
7.4 Gagosian does not accept any responsibility if you are not able to take up the prize.
8. Limitation of liability
8.1 Gagosian makes no representation in relation to the suitability, condition, or safety of the prize. You acknowledge (and shall procure that your guest also acknowledges) that taking up the prize may involve risks and dangers of accidents, personal and bodily injury and property loss or damage. You confirm (and shall procure that your guest also confirms) that both you and your guest are in good health and have no medical or health condition that could endanger or limit your abilities whilst participating in the prize. You confirm (and shall procure that your guest also confirms) that you and your guest understand, have considered and have evaluated the nature, scope and extent of the risks involved, and voluntarily and freely choose to assume these risks. Gagosian does not provide any insurance, whether life or medical or liability, for any illness, accident, injury, loss or damage that may arise in connection with you or your guest’s participation in the prize.
8.2 Insofar as is permitted by law, Gagosian, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of, or related to, taking up the prize (including but not limited to where any winner has failed to provide any accessibility, allergy and/or dietary restrictions / requirements of themselves or their guest) except where it is caused by the negligence of Gagosian, its agents or distributors or that of their employees. Your statutory rights are not affected.
8.3 In accepting the prize, you irrevocably agree to be solely responsible for informing Gagosian of any accessibility needs, dietary restrictions / requirements you or your guest may have.
9. Data protection and publicity
9.1 Gagosian will only process your personal information as set out in Gagosian’s Privacy Policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.
10. General
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, Gagosian may, at its sole discretion, reserve the right to exclude you from participating in the competition.
10.2 Gagosian reserves the right to hold void, suspend, cancel, or amend the prize competition without prior notice when circumstances beyond Gagosian’s control make it necessary to do so.
10.3 Unless otherwise stated, these terms and conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between them, whether written or oral, relating to its subject matter.
10.4 If any provision in these terms and conditions is held, in whole or part, to be invalid or unenforceable for any reason, the validity of the remaining provisions of these terms and conditions shall not be affected, and they shall continue to be valid and enforceable. The invalid or unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision.
10.5 These terms and conditions will be governed by English law and are void where prohibited or restricted by law and the parties submit to the exclusive jurisdiction of the English courts.
